Get guidance on Public Health Act powers

Published on 28 March 2024

Safeguarding public health is fundamental to the work of the NHS. The Public Health etc (Scotland) Act 2008 gives various powers to doctors appointed by health boards to protect public health.

When a public health issue arises, we can assist with advice and taking court action if required.

How can we help with public health issues?

Our litigation solicitors can:

  • give advice on the powers of health boards in terms of the Public Health etc (Scotland) Act 2008.
  • get involved in decisions to be taken about a public health measure
  • take action in court, if compulsory measures must be taken.
  • assess the urgency of action required
