I would be most grateful if you would provide me, under the Freedom of Information Act, details in respect to the contract below.

  • Name of suppliers who applied for inclusion on each framework and were successful and not successful at the PQQ & ITT stages?
  • Ranking of all successful and not successful suppliers at the PQQ & ITT stages?
  • Total value of the awarded framework?
  • Actual spend on this framework (and any sub lots), from the start of the contract to the current date?
  • Start date of framework?
  • Expiry date of framework?
  • Is there an extension clause in the framework(s) and, if so, the duration of the extension?
  • Has a decision been made yet on whether the framework(s) are being either extended or renewed?
  • What are the contractual performance KPI's for this contract?
  • Could you please provide a copy of the product specification given to all bidders for when this contract was last advertised?
  • Who is the senior officer (outside of procurement) responsible for this contract?

Please find attached Appendix 1 – NP599 Rankings, for the rankings per lot at the ITT stages.

Total value of the awarded framework?

The total value of the awarded framework at time of award was £4.6m per annum for sales via the National Distribution Centre.

Actual spend on this framework (and any sub lots), from the start of the contract to the current date?

Please find attached Appendix 2 – Lot spend data NDC, which shows the spend for this framework from October 2021 to September 2022 (12 Months) and October 2022 to August 2023 (11 months) for sales sold via the National Distribution Centre (NDC), Larkhall.

Start date of framework?

The start date for this framework was 1st October 2021.

Expiry date of framework?

The expiry date of this framework is 30th September 2024.

Is there an extension clause in the framework(s) and, if so, the duration of the extension?

The authority has the option to extend for 2 x 12 months period.

Has a decision been made yet on whether the framework(s) are being either extended or renewed?

No decision has been made on whether the extensions will be utilised.

What are the contractual performance KPI's for this contract?

Under Section 17 of the Freedom of Information Scotland Act, 2002 (FOISA) an organisation does not have to provide that information if it does not hold that information. NHS National Services Scotland (NSS) cannot provide this information, as there are no key performance indicators (KPIs) outlined for this framework.

Could you please provide a copy of the product specification given to all bidders for when this contract was last advertised?

The minimum standards applicable to bid were as follows:

Suppliers must be compliant to the following ISO certification or equivalent: ISO9001:2015 or ISO13485:2016 CE Marking & Directive 93/42/EEC relevant to the Products within the scope of the Framework Agreement Provision of valid certification for these standards (or equivalent) is required for this procurement.

Who is the senior officer (outside of procurement) responsible for this contract?

Under Section 17 of the Freedom of Information Scotland Act, 2002 (FOISA) an organisation does not have to provide that information if it does not hold that information. NHS National Services Scotland (NSS) cannot provide this information, as each individual Health Board (HB) will have their own senior officer who will be responsible for this contract, NSS or NSS National Procurement (NP) do not retain this list.
