NSS have applied the FOISA s38(1)(b) exemption for “Third Party Personal Information” to names and direct contact details of non-senior staff. This group of staff have no expectation that this personal information would be disclosed into the public domain.

Disclosure of this personal information would contravene Article 5(1)(a) of the UK General Data Protection Regulation, where personal data shall be processed lawfully, fairly and in a transparent manner in relation to the data subject.

The names and job titles of staff have been redacted under FOISA s39(1) exemption for “Health & Safety” . This exemption contains a Public Interest Test and NSS has determined that there is absolutely no public interest in exposing NHSScotland staff to situations that will adversely affect their mental or physical health and wellbeing.
