Request

Under the Freedom of Information (Scotland) Act 2002, please provide the following information relating to contract NP507420 (NHS NSS & NES eRostering System):

  1. The names of all organisations that submitted tenders in response to the procurement (i.e. the four tenderers).
  2. The dates on which those tenders were submitted/received.
  3. Any public documents identifying unsuccessful tenderers (if available).

If any of the requested information is withheld under a statutory exemption, please provide the relevant exemption reference and a brief explanation of the public interest consideration.

Response

We have now completed the search of our records and can provide you with the following information:

1. The names of all organisations that submitted tenders in response to the procurement (i.e. the four tenderers).

Under section 33(1)(b) of the Freedom of Information Scotland Act, 2002 (FOISA) we have determined that some of the information you requested is exempt under the Act. This exemption applies where disclosure of the information would, or would be likely to, prejudice substantially the commercial interests of any person or organisation, including public authorities. In this case, releasing the information could:

  • undermine the competitive position of the organisations concerned.
  • reveal commercially sensitive strategies, pricing, or operational details
  • harm ongoing or future negotiations or contracts.

We recognise that there is a public interest in transparency and accountability. However, on balance, we consider that the public interest in withholding the information outweighs the public interest in disclosure, due to the potential for substantial harm to commercial interests. What we can provide you with is the name of the organisation who was successful - Allocate Software Limited, View Notice - Public Contracts Scotland.

2. The dates on which those tenders were submitted/received.

The submission date was 22 May 2019.

3. Any public documents identifying unsuccessful tenderers (if available).

Under Section 17 of FOISA an organisation does not have to provide that information if it does not hold it. NSS cannot provide any information as there are no public documents identifying these tenderers.
