I am writing to you under the Freedom of Information Act to request information on the following public sector contracts procured:

  1. The winning tender response from Cap Gemini for ITT: itt_62391 - Digital Delivery Services (PaCC Systems Project).
  2. The winning tender response from Cap Gemini for Digital Delivery Services / Contract No: NP06925MC.
  3. The winning tender response from Deloitte for Digital Delivery Services / Contract No: NP06925MC.

I understand that any information which was declared as sensitive may be redacted.

Response

We have now completed the search of our records and can provide you with the following information:

Under section 33(1)(b) of the Freedom of Information Scotland Act, 2002 (FOISA), NHS National Services Scotland (NSS) has determined that the information you requested is exempt under the Act. This exemption applies where disclosure of the information would, or would be likely to, prejudice substantially the commercial interests of any person or organisation, including public authorities. In this case, releasing the information could:

  • undermine the competitive position of the organisation concerned
  • reveal commercially sensitive strategies, pricing, or operational details
  • harm ongoing or future negotiations or contracts.

We recognise that there is a public interest in transparency and accountability. However, on balance, we consider that the public interest in withholding the information outweighs the public interest in disclosure, due to the potential for substantial harm to commercial interests.
